Enforcibility of Restrictive Covenants with Particular Reference to the Sussex Area LIVE Webinar

The majority of freehold titles will have at least one restrictive covenant and the majority are unenforceable against the parties.  This course aims to look at enforceability and will, in particular, look at the enforceability at some of the covenants found in Sussex.  Topics covered include:

  • Enforceability against the original party.
  • Discharge of covenants under the Law of Property Act 1925 and the Housing Act 1985.
  • Passing of the benefit.
  • The need for a dominant title with particular reference to Sussex.
  • The passing of the burden.
  • Enforceability of positive covenants and estate rentcharges.

Richard Snape has been the Head of Professional Support at Davitt Jones Bould since 2002.   He speaks at numerous courses for law societies all over the country, various public courses, in-house seminars within solicitors’ firms and has also talked extensively to local authorities and central government bodies.  His areas of specialism include both commercial and residential property, in particular in relation to local government law, conveyancing issues, development land, commercial property and incumbrances in relation to land.
